– Delivery times and product availability

Orders are processed as they come in. Plants are reserved upon receipt of payment for the order and shipped the following Monday for delivery from Wednesday in France, from Thursday in Germany, Belgium, the Netherlands, Switzerland, Luxembourg, the United Kingdom, Italy, Spain and Portugal.

You may postpone delivery to a date that suits you best or specify a delivery address different from the billing address.

– Availability

All products on the site are available.

When a variety is out of stock, we do not replace it. We will reimburse any out of stock variety, after your order has been shipped, by bank transfer to your account.

– Minimum order : 6 plants

– Payment

Orders are confirmed and shipped only upon receipt of the payment by bank card or by bank transfer.

– Damage during transport

Any damage due to transport is the responsibility of the Post Office or carrier and we cannot be held responsible for this in any way whatsoever.

In every case, it is best to accept the package (as plants are live products, they would suffer if you send them back) and then contact us.

We will investigate and then do everything possible to compensate for any damages.

– Implementation of the warranty and after sales service

If you wish to make a complaint, please contact us within 48 hours and we will do everything possible to redress any negligence.

As we no longer care for our plants after they have left the nursery, we cannot guarantee that they will thrive.

– Settlement of disputes: the Tribunal de Commerce de Vannes (Brittany – France) has exclusive jurisdiction.

– Acceptance of conditions

The customer acknowledges, at the time of ordering, the special Terms and Conditions set out on this page and expressly accepts them without reservation. These general Terms and Conditions govern the contractual relationship between the Le Clos d’Armoise nursery and their customers, which all parties accept without reservation.

– Products

The photographs used to illustrate our products are not contractual. The brittanyperennials.uk website cannot be held responsible in any way whatsoever for any errors in the photographs.

– Orders

The automatic registration systems are considered as proof of the nature, content and date of the order. The Le Clos d’Armoise Nursery sends a confirmation of the order by email to the customer’s email address. The sale will only be finalised after confirmation of the order and receipt of payment.
The Le Clos d’Armoise Nursery reserves the right to cancel any order from a customer with whom there is a dispute over payment for a previous order.

The details provided by the purchaser when making an order are binding on him/her: if there are any errors in the delivery address, the vendor cannot be held responsible for non-delivery of the order.

– Delivery

After order confirmation, the Le Clos d’Armoise Nursery undertakes to deliver all items ordered by the purchaser to the carrier. The carrier is under contractual obligation to the Le Clos d’Armoise Nursery to deliver orders to the purchaser’s address as supplied by the Le Clos d’Armoise Nursery.

For deliveries outside mainland France, the customer agrees to pay any taxes due on the importation of goods, customs duty, value added tax and any other taxes applicable under the legislation of the recipient country.

All orders made outside mainland France are intended for the customer’s personal use.

Any partial or full resale of products by customers or recipients of products is forbidden. The Le Clos d’Armoise Nursery cannot be legally held responsible if the customer fails to pay any taxes due. Delivery will be made by La Poste’s Colissimo service depending on the customer’s choice of transport in France.

Deliveries are made in a time slot scheduled with the customer. Orders are handed directly to the addressee of the order or to another person designated by the customer.

Possible delays do not entitle the customer to claim compensation.

Deliveries within the European Union are made by the La Poste’s Colissimo Europe tracked service. Deliveries outside the European Union are made by international postal services.

The following are considered as force majeure events releasing the vendor from obligation to deliver: war, riot, fire, strikes, accidents and the impossibility of being supplied.

Merchandise is always shipped at the recipient’s risk and peril. Please always check your parcel on arrival.

You have 48 hours in which to lodge a claim with the carrier in case of missing or damaged goods.

– Returns and refunds

You may return unwanted goods within 7 days (starting from the date of receipt of the goods). If you wish to exchange your goods or have a refund, please return complete items in their original packaging to the following address Le Clos d’Armoise Nursery, Moustoir Lorho, 56450 Theix, France.

If you wish to return your goods, the Le Clos d’Armoise Nursery will refund the amount paid by the client with no deduction for expenses. Refunds will be made within a maximum of 15 days.

– Prices

Prices are in Euros. The price indicated on the product description does not include shipping. The price indicated in the order confirmation is the final price inclusive of all taxes such as VAT for France and other European Union countries. The price includes the product price, handling, packing and product care costs and shipping.

– Disputes

The Le Clos d’Armoise Nursery reserves the right to refuse orders from customers with whom there has been a dispute.

The present Terms and Conditions are subject to French law. The Le Clos d’Armoise Nursery will not be held responsible for any damage of whatever nature arising from the improper operation or usage of any items sold.

The liability of the Le Clos d’Armoise Nursery will, whatever the nature of the dispute, be limited to the amount of the order. The nursery will not be held responsible for simple errors or omissions which could arise despite all the precautions which were taken in presenting the products.

Should difficulties arise in applying the provisions of these Terms and Conditions, the purchaser may, before taking legal action, seek an amicable solution with the assistance of a trade or consumers’ association or any other advisory body of his/her choice. Seeking an amiable solution to a dispute does not suspend the “short period” of the legal warranty nor affect the duration of the contractual warranty.

As a general rule and subject to Court rulings, the respect of the provisions of these Terms and Conditions relating to the contractual warranty assumes that the purchaser has honoured his/her financial commitments to the vendor. Claims or disputes will always be given careful consideration, and claimants are always presumed to be acting in good faith. When a dispute arises, the customer will always make an initial claim to the company to obtain a satisfactory settlement. Failing this, the Tribunal de Commerce de Vannes has exclusive jurisdiction, regardless of the place of delivery and payment method.

– Warranty

As we no longer care for our plants after they have left the nursery, we cannot guarantee that they will thrive.

In all instances, the Le Clos d’Armoise Nursery cannot be held responsible for non-compliance with regulations and laws in force in the recipient country.

The Le Clos d’Armoise Nursery’s liability is always limited to the value of the product in question on the date of sale. There shall be no right of appeal to the brand or company that produced the product. In every case, the customer benefits from the legal warranty of eviction and latent defect (Art. 1625 and following of the Civil Code).

Provided that the purchaser gives proof of the latent defect, the vendor must legally make reparation for all its consequences (Art. 1641 and following of the Civil Code). If the purchaser initiates court proceedings, s/he must do so within a “short period” after the discovery of the defect (Art. 1648 of the Civil Code).

– Legal information

Personal data has to be collected for the purposes of distance selling. This information is essential for the processing and delivery of orders, preparing invoices and warranties.
Failure to provide information will result in the order not being completed. In accordance with French data protection legislation, the processing of customers’ personal information has been registered with the Commission Nationale Informatique et Libertés (CNIL).

Customers are entitled (Art. 34 of the Law of 6 January 1978) to access, modify, correct and delete data pertaining to them and can exercise this right with the Le Clos d’Armoise Nursery.

Furthermore, the Le Clos d’Armoise Nursery undertakes not to communicate, with or without consideration, customer data to third parties.
